You should read these terms and conditions carefully before buying from us, and we recommend you keep a copy for your own reference.

1.       ABOUT US

1.1. This website is owned and operated by: YoungAir of 267 Wells Road, Malvern, Worcestershire. Calls are charged at your network providers’ standard rate.

1.2. By using this website and ordering goods from it, you agree to these terms and conditions (the “Conditions”) and you accept that the Conditions and your use of the website shall be governed by English law and are subject to the exclusive jurisdiction of the English courts. Nothing in these Conditions affects your statutory consumer rights.

1.3. Remember to check the Conditions when you use the website as we may change the Conditions from time to time and you will be subject to the Conditions in force at the time that you use the website. We may change the prices and availability of goods without notice to ensure they are as up to date as possible.

2.    HOW TO PLACE AN ORDER

2.1.    Once you have chosen the goods that you want to order place the goods in the online shopping cart and proceed to the checkout.  You can remove items and amend the quantities when you are in the shopping cart. Complete the order by providing your details or registering with YoungAir. Please ensure that any information you provide to us is accurate and current.

2.2.    Payment for the goods which you order must be made by either PayPal or by the available method provided in the secure checkout area.

2.3.    By placing an order you are offering to buy goods from us.  We will let you know that we have received your order but this does not mean that your order has been accepted.  There is no contract between us until we have accepted your order.

2.4.    When we have accepted your order, we will confirm this in an email or by post. Keep your confirmation in a safe place in case of any query.  At this point both parties enter a contract of sales which is legally binding.

2.5.    If we cannot supply you with the goods you have ordered we will let you know by email.  We will not supply you with substitute goods.

3.    DELIVERY

3.1.    Prices quoted are inclusive of delivery (unless specified) to mainland UK destinations.  We will try to deliver the goods within 5 days of the acceptance of your order, subject to availability of stock.  Delivery dates of the goods are intended to be an estimate only, but we will make delivery at the latest within 28 days of acceptance of your order.  If you order more than one product, your order may be dispatched separately and may be delivered to you at different times.

3.2.    If the delivery address refuse delivery of the goods or if you do not respond to the “sorry we missed you” card left by the delivery driver, your order will be returned to the sender (YoungAir) we will then wait for you to contact us before we refund you your money minus the return postage cost. Business to Business transaction are exempt from this right.

3.3.    If you provide us with a wrong delivery address and your goods are signed for by another party, YoungAir cannot be held responsible for any loss you incur as a result.

3.4.    For delivery to areas outside of the UK mainland and timed deliveries we will provide an individual quote based on weight/size of goods ordered and delivery location, please contact helpdesk@youngair.co.uk for details.

3.5.    Please inspect your delivery and report any goods found to be damaged or faulty within 5 working days or receipt of delivery.

3.6.    Please allow 28 days for delivery (from the date of acceptance of order) before reporting your order as undelivered. Most items are available for delivery within 28 days of your order. If we are unable to supply you with your goods within this time, we will contact you to let you know and give you a revised delivery date. You will be given the option to cancel or amend your order if this is the case.

3.7.    If we fail to supply you, or supply you with goods that you find to be damaged, faulty or misdescribed after a reasonable examination, we will replace the item free of charge or refund your money. In these circumstances we reserve the right to ask you for independent confirmation of any claimed faults.

4.    YOUR RIGHTS WHERE GOODS ARE NOT SATISFACTORY QUALITY, FIT FOR THEIR PURPOSE OR MISDESCRIBED

4.1.    Repair or replacement

4.1.1.    Unless they have faults reported to us as a result of your initial examination of the goods (see 3.4), we will repair any goods that are faulty, unsatisfactory or unfit for their purpose (see 4.1.2), or offer you a like-for-like replacement (see 4.1.3). If we supplied you with the goods more than six months ago, we reserve the right to ask you to prove that the goods were faulty when we supplied them to you.

4.1.2.    If we offer you a repair, and a repair is not possible or not possible within a reasonable period of time, we will offer you a refund equivalent to the replacement cost of the item, taking into consideration its age and any fault-free use you have had from it.

4.1.3.    If we offer you a replacement and a like-for-like replacement is not available, or not available within a reasonable period of time, we will offer you a refund equivalent to the replacement cost of the item, taking into consideration its age and the fault-free use you have had from it.

4.1.4.    Any additional costs associated with repair or replacement of faulty goods will be borne by us. This will include the cost of return delivery of the item to us or to a mutually acceptable third party repairer (see 4.1.6).

4.1.5.    Replacements and refunds will be on a like-for-like basis. This means you may not receive a new item as replacement or a full refund if you have had the goods for a while or if you have had a reasonable period of fault free use from them.

4.1.6.    We reserve the right to ask for independent third party confirmation of any faults. If this is necessary, we will initially bear the costs but may ask you to reimburse us if the goods are found to be satisfactory. We shall inform you that we intend to seek confirmation of the claimed faults before we do so and who we will be approaching to do this. You may suggest alternative independent third party.

4.1.7.    Goods with faults due to normal wear and tear or damage caused by misuse will not be repaired or replaced free of charge.

4.2.    Refunds and Returns

4.2.1.    Full refunds will be given as a result of claims under Section 3.6. All other refunds will be based on the replacement cost of the goods. This means you may not receive all the money you paid.

4.2.2.    Money will be refunded to the same account debited during purchase. All refunds and partial refunds will be completed within 30 days.

4.2.3     YoungAir is deemed to have no knowledge of the particular purpose or market for which the goods are required unless the contract specifies. The customer is deemed to have purchased the goods relying on the customers own knowledge and expertise after making due enquiry.

4.2.4      On trade and other business to business sales YoungAir will accept returns within a period of 28 days for a credit refund less 25% restocking charge as long as the items are undamaged, in the original packaging and in as new condition. Or a like for like replacement if the goods returned are undamaged. The customer is liable for all return courier charges.

5.    YOUR RIGHTS UNDER THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS. (Business to Business transaction are exempt from the Distance Selling Regulation)

5.1.    Under the Consumer Protection (Distance Selling) Regulations 2000 (as amended), you have an unconditional right to cancel your order within seven working days from the day after the day of delivery. PLEASE NOTE: You must take reasonable care of the goods during the cancellation period.

5.1.1.    To cancel your order under the Distance Selling Regulations (DSR):
-    Send an email, fax or write to us telling us you wish to cancel the order. Include enough information for us to identify you and your order. As per our address shown in section 1.1 or fax number 01684 575874 or email to helpdesk@youngair.co.uk
-    You must return the goods to YoungAir in their original packaging to us at your expense.  Parcel up the items you are returning securely to minimise any damage that may be caused during delivery. Please include a copy of your notification of cancellation or order confirmation so we can trace your order quickly.  Note that if you fail to take reasonable care of the goods we might not be able to accept their return. Otherwise, we will refund the full purchase price to you to the card you originally used for the purchase.

5.1.2.    Once you have notified us of your intention to cancel the contract we will refund you the cost of your order and its delivery as soon as we can. This will always be within 30 days of your cancellation.

5.2.    This section of the policy does not affect your legal rights as outlined in sections 3 & 4.

6.        PRODUCT GUARANTEES
 All items purchased from YoungAir online shop are covered by a 12 months guarantee.

6.1.    Accidental damage and damaged caused by misuse is not covered by this guarantee and therefore a charge will be made.

6.2.    This warranty does not affect your statutory rights (see 4.1.)

7.    PRICING

7.1.    Prices quoted are fully inclusive of VAT.

7.2.    From time to time we will have to change the prices of items. This will not affect the status of confirmed orders and in this case you will only pay the price contained in your order confirmation. If the prices of an unconfirmed order changes, we will let you know and give you the option of cancelling the order.

9.    ABOUT THESE TERMS

9.1.    These terms came into force on the 20/04/09 and apply to all orders made after 0800hrs on that day.
